The first of four brothers who sexually abused his younger sister receives 18 years in prison and 24 strokes

SINGAPORE – A 22-year-old man, who was the first of four brothers to sexually assault his younger sister, said he preferred to abuse her rather than have sex with a girlfriend because of his “experience of being heartbroken”.

On May 21, a High Court judge sentenced him to 18 years in prison and 24 lashes, higher than the sentence of 16 years in prison and 24 lashes requested by both the prosecution and the defense.

Judge Mavis Chionh said the sentence sought was insufficient to reflect the overall criminality of the man’s conduct and was not in line with sentences imposed in several previous cases.

The girl, now 14 years old, was sexually assaulted by her four older brothers from 2018 to February 2022, when she was between eight and 12 years old.

The perpetrator of the present case, her second older brother, was the first to start abusing her.

He pleaded guilty to three counts of aggravated rape and a further 16 counts of serious sexual offenses were taken into account during sentencing.

He was between 16 and 20 years old when he committed these crimes.

His sentencing came a day after the older brother, 23, was sentenced to 20 years in prison and 24 lashes.

The older man had pleaded guilty to eight counts of aggravated sexual assault by penetration, and a further 34 counts of serious sexual offenses had been taken into account.

Judge Chionh noted that the older brother faced more charges.

But the judge highlighted that, unlike his older brother, most of the crimes committed by the author in the present case involved the actual completion of rape.

The judge also considered that the victim suffered symptoms of trauma and has been separated from her two younger sisters and her parents.

Deputy Public Prosecutor M. Kayal Pillay told the court that the offender in the current case admitted to having sexually assaulted the victim on more than 10 occasions and often took advantage of her while she was sleeping.
